1 - Preamble

This data protection declaration shows how Landbörse AG (hereinafter Landbörse) collects, uses, passes on and discloses personal data (visitors) from the visitors of this website (hereinafter users) (in the following summarised under the term “process”) and in what way this happens. The declaration also describes how Landbörse guarantees the security of the processed personal data.

The user agrees that Landbörse processes personal data in accordance with the present declaration. This declaration does not affect statutory or contractual confidentiality obligations to which Landbörse is subject in relation to the user’s personal data.

Landbörse can unilaterally change the declaration at any time. Landbörse publishes a current version online.

2 - Data collected

Landbörse processes personal data about the user when he

  • visits the Landbörse website;
  • requests or uses products, services or information offered online by Landbörse; this includes, in particular, registration for specific services or web content that can only be accessed with a personal login, as well as subscriptions to print media or online newsletters;
  • acquires, installs and/or uses apps or other applications from Landbörse via appropriate app stores.

In selected cases, personal data is processed when Landbörse records telephone calls from users, either to fulfil their own legal obligations or for training or quality assurance purposes.

On the one hand, Landbörse processes the personal data (e.g. name, address, e-mail address, telephone or fax number, extract from the commercial register, data about the property to be sold) that the user explicitly and actively provides to Landbörse. This also applies if the user participates in events (online or in person) from Landbörse. On the other hand, the Landbörse web server automatically records details of the user’s visit (e.g. IP address, browser type and version, operating system used, website of origin, pages viewed, date, length of stay).

3 - Cookies

The Landbörse website uses cookies that are stored on the user’s computer. This enables Landbörse to understand the user’s visit and save his preferences if he switches between pages and then visits the website again.

Cookies have the following functions:

  • storage of the language and country settings selected by the user;
  • statistical evaluation of the number of users and usage habits;
  • improvement of the loading speed of the individual pages.

The user can control cookie behaviour by using the browser settings. The corresponding browser options and instructions for use can usually be found in the browser’s manual or help file. If the user rejects cookies, blocks or deactivates them, this can restrict the availability of the services offered via the website. In addition, parts of the website may no longer function as intended.

We use the information to compile reports and to help us improve the site for you. The cookies collect information in an anonymous form, including the number of visitors to the site, where visitors have come to the site from and the pages they visited.

4 - Data transmission to third parties

Payments

If the user selects a payment service provider in the ordering process, Landbörse shall forward the payment data collected for this purpose to the payment service provider commissioned with the payment. Some of the selected payment service providers also collect this data themselves, provided you create an account there directly. This means that this data is the exclusive responsibility of the payment service providers under data protection law; see the links below for the respective data protection declarations.

Web analysis

Landbörse analyses the use of the website with analysis tools from third parties such as Google Analytics or eTracker (hereinafter “analysis service provider”). Landbörse assumes no responsibility or liability for any data processing by the providers of these tools.

Google Analytics

Google Analytics, a web analytics service provided by Google Inc. (hereinafter “Google”), uses cookies that are stored on the user’s computer. The information generated by the cookie about the user’s visit is usually transmitted to a Google server in the USA and stored there. If Landbörse activates IP anonymisation for this website, Google shortens the user’s IP address within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the USA and anonymised there. On behalf of Landbörse, Google evaluates the stored information in order to compile reports on the use of the website and to provide other related services for Landbörse. Google may combine the IP address transmitted by the user’s browser as part of Google Analytics with other data collected.

5 - Use and protection of personal data

With the processing of personal data in accordance with this declaration, Landbörse can improve product and service quality.

The processing of personal data serves the following purposes in particular:

  • Technical administration as well as research and further development of the website;
  • User administration and marketing;
  • Information of the user about services and products from Landbörse, if the user has given his consent.

The user authorises Landbörse to pass personal data on to employees, agents or other third parties within or outside the country in which the user lives to provide services and for the purposes mentioned above. Landbörse obliges employees, agents and other third parties who have access to personal data to ensure compliance with all applicable data protection regulations. Persons to whom Landbörse grants access to personal data within the meaning of this declaration will be trained accordingly with regard to data security and data protection.

Landbörse protects personal data with appropriate physical, electronic and procedural safeguards, including firewalls, personal passwords, encryption and authentication technologies. If personal data is collected from a Landbörse website in individual cases, the transfer shall be encrypted using the currently most common and most secure data transfer method, SSL (Secure Socket Layer).

Landbörse reserves the right to transmit personal data to government and supervisory authorities and, in the context of this declaration, also to analysis service providers. Landbörse fully adheres to the applicable regulation, legislation and any judicial or official requirements.

6 - Information about processed personal data

Persons whose personal data are processed in the context of this declaration have the right:

  • to receive information about whether and which personal data are stored by Landbörse;
  • to receive a copy of said personal data;
  • to request the correction of personal data in the event of errors;
  • to request restrictions on the processing of personal data;
  • to receive personal data in a structured, common and machine-readable format;
  • to object to the processing of the data, in particular for the purpose of direct advertising.

The above-mentioned rights can be denied or restricted if the interests, rights and freedoms of third parties prevail or if the processing serves to assert, exercise or defend legal claims of Landbörse. An inquiry must be made in the form of a registered letter. Landbörse reserves the right to request any inquiries from the user during the inquiry process to identify the applicant.

7 - Links

The Landbörse website may contain hyperlinks to other websites that Landbörse itself does not operate or monitor. Third-party websites are not subject to this statement. Landbörse is not responsible for the content or handling of personal data.

8 - Social Media Buttons

Functions (plug-ins) from third-party providers or from social media platforms (Facebook, Twitter, Google+ etc.) are integrated on the Landbörse site. These plug-ins enable the user to share content on the aforementioned social networks. The buttons are deactivated by default when the website is accessed. This means that without the user’s intervention, no personal data will be transmitted to the respective third party provider. After the user has activated the buttons, the plug-ins automatically generate data, including personal data transmitted to the corresponding third-party provider. If the user is logged into the network of the respective third-party provider when visiting the website, the third party can assign the visit to the user’s network account. Landbörse has no influence on this. The purpose and scope of this data collection and the further processing and use of personal data are set out in the data protection notices of the respective social networks. The users also receive information on rights and setting options regarding the protection of privacy there.

9 - Right to withdraw consent under data protection law

Any person affected by the processing of personal data can withdraw their consent at any time. In this case, the revocation must be sent in writing (by registered mail) to the Data Protection Officer at Landbörse.
